1. About This Platform
Licet ("the Platform", "we", "us") is an AI-assisted educational tool designed to help registered health practitioners and health service providers identify potential advertising compliance risks against the Health Practitioner Regulation National Law ("National Law"), the Therapeutic Goods Act 1989 (Cth), and associated guidelines published by the Australian Health Practitioner Regulation Agency (AHPRA) and the Therapeutic Goods Administration (TGA).
The Platform uses automated pattern matching and artificial intelligence to analyse advertising content and identify language that may present compliance risk. It is intended to support — not replace — professional legal and regulatory advice.
2. Acceptance of Terms
By accessing or using this Platform, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. Your continued use of the Platform constitutes acceptance of any updates to these terms.
3. Nature of the Service — What We Are and Are Not
3.1 What This Platform Is
- An educational tool that identifies language patterns associated with AHPRA and TGA advertising risk
- A risk-identification and decision-support resource
- A starting point for compliance review processes
- An informational reference tool based on publicly available regulatory guidance
3.2 What This Platform Is Not
- Not legal advice. The Platform does not provide legal advice. No solicitor-client relationship is created by using this Platform.
- Not regulatory advice. Outputs from the Platform do not constitute advice from AHPRA, the TGA, the National Boards, or any regulatory body.
- Not a compliance certification. A result of "no issues detected" does not mean your content is compliant. It means our automated system did not identify specific patterns associated with known risk areas at the time of the check.
- Not exhaustive. The Platform cannot assess every possible compliance risk. It cannot evaluate visual elements, overall campaign impression in full context, tone, or nuance that a regulator would consider.
- Not affiliated with AHPRA or TGA. We are not associated with, endorsed by, or affiliated with AHPRA, the TGA, any National Board, or any government body. References to regulatory guidance are made for educational purposes only.
4. No Guarantee of Compliance
Use of this Platform does not guarantee, confirm, or certify that your advertising content complies with the National Law, the Therapeutic Goods Act 1989, the AHPRA Advertising Guidelines, the TGA Advertising Code, the Australian Consumer Law, or any other applicable law or regulation.
Regulatory requirements change. AHPRA and TGA guidance is updated periodically. The Platform may not reflect the most recent regulatory position at any given time. You are responsible for independently verifying that you are working to current guidance.
AHPRA evaluates advertising based on the overall impression conveyed to a reasonable consumer. Automated pattern-matching cannot fully replicate this assessment. Content that passes this tool's checks may still breach the National Law when assessed by a regulator.
5. User Responsibilities
By using this Platform, you agree that:
- You are solely responsible for all advertising content you publish
- You will seek independent legal and regulatory advice before publishing content, particularly where significant compliance risk is identified
- You will independently verify any guidance provided by this Platform against current AHPRA and TGA published guidance
- You will not use this Platform as the sole basis for determining that advertising content is compliant
- You will not represent to any third party that content has been certified, approved, or cleared by this Platform
- You remain responsible for understanding and complying with your obligations as a registered health practitioner or health service provider
6. Disclaimer of Warranties
This Platform is provided strictly on an "as is" and "as available" basis. Your use of Licet is entirely at your own risk. To the maximum extent permitted by applicable Australian law, Licet and its operators expressly disclaim all conditions, representations, and warranties — whether express, implied, statutory or otherwise — including but not limited to any implied warranty of merchantability, fitness for a particular purpose, or non-infringement of third-party rights.
No advice or information, whether oral or written, obtained by you from Licet or through the Platform will create any warranty not expressly stated in these Terms.
Without limiting the foregoing, Licet, its operators, subsidiaries, affiliates, licensors, officers, directors, agents, partners, suppliers and employees do not warrant that:
- the content is accurate, reliable, complete, or correct;
- the Platform will meet your requirements;
- the Platform will be available at any particular time or location, uninterrupted or secure;
- any defects or errors will be corrected; or
- the Platform is free of viruses or other harmful components.
Any content downloaded or otherwise obtained through use of the Platform is obtained at your own risk. You are solely responsible for any damage to your computer system, mobile device, or loss of data resulting from such use.
Licet does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Platform or any hyperlinked website or service, and Licet shall not be a party to or in any way monitor any transaction between you and third-party providers.
7. Limitation of Liability
To the maximum extent permitted by applicable Australian law, in no event shall Licet, its operators, subsidiaries, affiliates, officers, directors, agents, co-branders, partners, suppliers, and employees be liable for:
- any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the Platform;
- any damage, loss or injury resulting from hacking, tampering or other unauthorised access or use of the Platform or the information contained therein;
- any errors, mistakes, or inaccuracies of content;
- any regulatory action, investigation, fine, penalty, or sanction arising from advertising content reviewed or produced with the assistance of this Platform;
- personal injury or property damage, of any nature whatsoever, resulting from your access to or use of the Platform;
- any unauthorised access to or use of our secure servers and/or any personal information stored therein;
- any interruption or cessation of transmission to or from the Platform;
- any bugs, viruses, trojan horses, or the like which may be transmitted to or through the Platform by any third party; or
- any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Platform.
Where liability cannot be excluded by applicable law, our total liability to you is limited to the amount you paid for the Platform in the 12 months preceding the relevant claim, or the re-supply of the relevant service, at our election.
8. Intellectual Property
All content, design, code, pattern libraries, and materials comprising the Platform are owned by or licensed to us. You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without our express written consent.
Content you submit to the Platform for analysis remains your property. By submitting content, you grant us a limited licence to process that content for the purpose of providing the service.
9. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose
- Attempt to reverse engineer, decompile, or extract the Platform's pattern libraries or AI prompts
- Represent Platform outputs as legal opinions or regulatory clearances
- Resell or commercially exploit the Platform without our written consent
- Submit content that infringes third-party intellectual property rights
10. Third-Party Services
This Platform uses third-party AI services (including Anthropic's Claude API) to process content submissions. Content you submit may be transmitted to and processed by these third-party services in accordance with their own terms and privacy policies. We recommend you do not submit sensitive personal health information, patient data, or confidential business information through this Platform.
11. Regulatory Currency
The Platform's pattern library and AI guidance are based on AHPRA and TGA guidance current as of the effective date of these Terms. Regulatory requirements change. We will endeavour to update the Platform when significant regulatory changes occur but make no commitment to do so within any particular timeframe. You are responsible for working to current guidance.
12. Changes to These Terms
We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the updated Terms. Material changes will be notified via the Platform.
13. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
